Ana kural bu olmakla birlikte, yargı içtihatları ve uluslararası kurallarla bu duruma bir takım istisnalar getirilmiştir.
Delil kavramı çok geniş bir kavram olması sebebi ile bu yazıda son günlerde gerek ceza yargılamasında gerekse boşanma davalarında sıklıkla gündeme gelen ‘’ses kaydı/ortam dinlemesi’’ sonucu elde edilen delillerin ispat hukukunda yerine değinilmekle yetinilecektir.
Ses Kaydının Hukukiliği Nedir?
Ortam dinlemesi ve ses kaydı olarak bilinen kavramlar Ceza yargılamasının ve hukuk yargılamasının üzerinde durduğu kavramlardır. Temel haklar çerçevesinde bakıldığında kural olarak bir kimseden habersiz alınan ses kayıtları hukuka aykırı delil olarak kabul edilip kullanılamayacağı gibi aynı zamanda suçtur. Boşanma Davalarında Hukuka Aykırı Deliller
Boşanma davaları, delillerin değerlendirilmesi konusunda kanunun temel sistematiğinden farklılaşan ve uygulama ile oluşturulan birçok kurala dayanan dava türüdür. Uygulamada birçok kimse elinde evlilik birliğinin sona ermesini gerektiren nedenleri ispatlayan ses kayıtları olmasına rağmen bu kayıtların kullanılamayacağından bahisle boşanma davası açamamakta, açsa dahi bu delilleri sunmadığı için hak kaybına uğramaktadır.
Bununla birlikte Yargıtay, bir delili değerlendirirken, hukuka aykırı elde edilmesi ile hukuka aykırı üretilmesi yönlerinden ayrı ayrı değerlendirilmesi gerektiğinin altını çizmiştir:
“Mahkemece, hükme esas alınan CD, davalı kadının rızası dışında kaydedildiği gibi sırf boşanma davasında delil olarak kullanılmak amacıyla bir kurgu sonucu oluşturulmuştur. “Yukarıda ifade edildiği üzere, bir delilin usulsüz olarak elde edilmesi ayrı, usulsüz olarak yaratılması ayrı bir olaydır. Usulsüz olarak elde edilen bir delil somut olayın özelliğine göre değerlendirilebilirse de; usulsüz olarak yaratılan bir delilin hiçbir şekilde delil olarak kabulü olanaklı değildir. Davacının konuşmalarının kendisinden habersiz olarak davalı Berrin’in yönlendirmesi ile diğer davalılarca kaydedildiği ve kayıt yapan davalıların davacıyı konuşmaya ve kendisini yönlendirmeye çalıştıkları bilirkişi tarafından dökümü yapılan ses kayıtlarından da anlaşılmaktadır. Bunun yanı sıra boşanma davalarında sosyal medya araçlarında (facebook, twitter gibi) alınan görüntüler de delil olarak sunulabilecektir. Aile bireyleri arasında mahremiyet olmaz düşüncesi gereğince, eşler boşanma davasında bu verilerden de yararlanabilecektir.
Yargıtay 2007 yılında vermiş olduğu kararında eşler arasındaki giz alanının sınırlarını şu şekilde çizmiştir:
‘’Bir delilin elde edilişi, kişilerin Anayasa ile tanınmış hakların ihlali suretiyle gerçekleşmiş ise, onun hukuka aykırı olarak elde edildiğinin kabulü gerekeceğinde duraksama bulunmamaktadır. Delilin elde edilişinde hukuka uygunluk nedenleri varsa, o zaman kanuna aykırılık ortadan kalkar. Kuşkusuz Anayasaya göre; herkes özel hayatına ve aile hayatına saygı gösterilmesini isteme hakkına sahiptir. Özel hayatın ve aile hayatının gizliliğine dokunulamaz. Ancak, evlilik birliğinde eşlerin, evliliğin devamı süresince birbirlerine sadık kalmaları da yasal bir zorunluluktur.
Eşlerden birinin, bu alana ilişkin özel yaşamı, evlilikle bir araya geldiği ve birlikte yaşadığı hayat arkadaşı olan diğer eşi de en az kendisininki kadar yakından ilgilendirir. O nedenle, evlilikte, evlilik birliğine ilişkin yasal yükümlülükler alanı, eşlerin her birinin özel yaşam alanı olmayıp, aile yaşamı alanıdır. Bu karar doğrultusunda hukuka uygun olarak elde edilmiş, yani yaratılmamış ses kaydının boşanma davasında delil olarak kullanabilmesinin mümkün olduğu görülmektedir.
“Boşanma davasının zaten kişilerin özel yaşamını ilgilendiren bir dava olduğu ve kocanın eşi ile birlikte yaşadıkları mekanda ele geçirdiği eşine ait fotoğrafları, not defterini veya mektupları mahkemeye delil olarak verilmesi halinde, bu deliller hukuka aykırı yollardan elde edilmediğinden mahkemede delil olarak değerlendirileceği; aynı evde yaşayan kadının, kocanın bu delilleri ele geçirilebileceğini bilebilecek durumda olduğu, kocanın yatak odasındaki bir dolabın içinde yada yatağın altında kadın tarafından saklanan bir not defterini ele geçirmesinin, bu mekan eşlerin müşterek yaşamlarını sürdürdükleri bir yer olduğundan kadın için gizli mekan kabul edilemeyeceği; hiç kimsenin evindeki bir mekanda bulduğu bir delili hukuka aykırı yollardan ele geçirmiş sayılamayacağı, özel hayatın gizli alanlarının, özel hayatın gizli alanını ilgilendiren delillerle ispat edilebileceği” vurgulanarak davalıya ait günlük delil olarak kabul edilmiştir.” T.C. Bununla birlikte delil listesinde gösterilmeyen ve karşı tarafın da muvafakat etmediği ses kaydına dayanılamayacağı pek tabiidir:
“Toplanan delillerden davacının eşine fiziksel şiddet uyguladığı, hakaret ettiği, eşini kovduğu, birlik görevlerini yerine getirmediği anlaşılmaktadır. Davacı tarafından kadına ait olduğu iddia edilen ses kaydını ihtiva eden kaset, delil listesinde bulunmadığı gibi; davalının da buna muvaffakat etmediği, bu nedenle bu kasetin delil olarak kabul edilmesinin mümkün bulunmadığı görülmektedir.” T.C. Yargıtay 2. Hukuk Dairesi’nin aşağıdaki kararında, koca tarafından eşinin cep telefonundan casus programla kaydettiği konuşmalar dahi hukuka uygun bir delil olarak kabul edilmiş ve mahkemenin kararı doğru bulunarak onanmıştır. Üye hakimin aşağıdaki gerekçelerle karşı oyu dikkat çekicidir:
“Taraflar arasında birleştirilerek görülmekte olan boşanma davasında, davacı-davalı (koca) tarafından mahkemeye delil olarak sunulan, davalı-davacıya (kadın) ait ses kayıtlarına dair cd.’lerin, davalı-davacının “özel hayatının gizliliği” ihlal edilmek suretiyle hukuka aykırı yolla elde edildiği, bu sebeple delil olarak kullanılamayacağı ileri sürülmüş; mahkeme ve sayın çoğunluk tarafından da bu şekilde elde edilen delilin değerlendirilebileceği kabul edilmiştir.” T.C. Fakat Yargıtay 2. Hukuk Dairesi, yukarıdaki görüşünü değiştiren şu kararı benimsemiştir:
“Mahkemece davalı-karşı davacı kadının daha fazla kusurlu olduğu kabul edilerek her iki boşanma davasının kabulüne karar verilmişse de yapılan yargılama ve toplanan delillerden; davacı-karşı davalı erkeğin dava dilekçesiyle dosyaya sunduğu ses kaydının hukuka aykırı delil olduğu bu sebeple hükme esas alınamayacağı ancak dosya içindeki diğer delillere göre davalı-karşı davacı kadının eylemlerinin güven sarsıcı davranış boyutunda olduğu, davacı-karşı davalı erkeğin ise eşine birden fazla şiddet uyguladığı, ağabeyinin davalı-karşı davacı kadına şiddet uyguladığı ve bu şekilde ailesinin müdahalesine sessiz kaldığı anlaşılmaktadır.” T.C.YARGITAY 2. Boşanma Davasında Mesaj İçeriği Tespit Edilebilir Mi?
Boşanma davası süresince taraf vekilleri olarak en çok duyulan soruların başında ‘’mesaj içeriğinin tespit ettirilip ettirilemeyeceği’’ gelir. Ceza Muhakemesi Kanununun 135. Maddesi hangi koşullarda mesaj içeriğinin kayıt altına alınabileceği hususunu düzenlemiştir. Bu madde gereğince, mesaj içeriğinin tespit edilebilmesi için öncelikle yapılan bir ceza soruşturma veya kovuşturmasında bir suç işlendiğine dair kuvvetli şüphe olmalıdır. Kuvvetli şüphenin varlığı tek başına yeterli değildir. Bunun yanı sıra yetkili merciin kararı gerekmektedir. Ancak bu şartlarda mesaj içeriğinin tespiti mümkündür.
Boşanma davalarında ise mesaj içeriğinin tespiti Aile Mahkemesinden istenemez. Aile Mahkemesi sadece ilgili operatörden isteyeceği bilgilerle mesaj atıldığı saati, numarayı, günü öğrenebilecektir. Ancak tarafların atmış oldukları mesaj, telefonlarının bünyesinde halen durmakta ise bu durumda var olan telefondan mesajın içeriği çıkartılabilecektir.
